Article 1: Definitions
1.1 Sunathlete: The sole proprietorship or company providing products and/or services as listed on the website www.sunathlete.com.

1.2 Customer: The natural person or legal entity entering into an agreement with Sunathlete.
1.3 Agreement: Any agreement between Sunathlete and the customer regarding the delivery of products and/or services.
1.4 Products: All goods offered by Sunathlete, such as infrared panels, infrared heat lamps, and blue blockers.

Article 2: Applicability
2.1 These general terms and conditions apply to all offers, agreements, and deliveries by Sunathlete, unless otherwise agreed in writing.
2.2 By placing an order with Sunathlete, the customer declares agreement with these terms and conditions.

Article 3: Offers and Prices
3.1 All offers and prices are non-binding and stated in euros, including VAT, unless otherwise specified.
3.2 Sunathlete reserves the right to change prices. Any changes will not apply to orders already placed.
3.3 Any shipping costs will be specified separately during the ordering process.

Article 4: Formation of the Agreement
4.1 An agreement is established once Sunathlete has confirmed an order from the customer in writing or electronically.
4.2 Sunathlete reserves the right to refuse orders or impose additional conditions.

Article 5: Delivery
5.1 Sunathlete strives to deliver products within the specified delivery period. Exceeding the delivery period does not entitle the customer to compensation or cancellation of the agreement unless the delay is unreasonable.
5.2 Delivery takes place at the address provided by the customer.

Article 6: Right of Withdrawal
6.1 The customer has the right to withdraw from the agreement within 14 days of receiving the products, without stating reasons.
6.2 To exercise the right of withdrawal, the customer must notify Sunathlete in writing or via email at [ENTER EMAIL ADDRESS] within the withdrawal period.
6.3 Products must be returned unused, in their original condition and packaging. Return shipping costs are borne by the customer.

Article 7: Warranty and Complaints
7.1 Warranty: Sunathlete guarantees that the delivered products comply with the agreement and the specifications stated in the offer. We provide a 2-year warranty on our infrared panels, starting from the date of purchase. This warranty covers manufacturing defects and faults that occur under normal household use according to the included instructions.
7.2 What is covered by the warranty:

  • Defective parts due to manufacturing or material defects.
  • Repair or replacement of the product, if necessary.

7.3 What is not covered by the warranty:

  • Damage caused by misuse, abuse, accidents, or unauthorized modifications.
  • Normal wear and tear or cosmetic damage that does not affect functionality.
  • Damage caused during transport if the product is not properly packaged for return.

7.4 Complaints: Any complaints about products or services must be reported in writing or via email to info@sunathlete.com within 14 days of delivery.
7.5 Handling of complaints: Sunathlete will process complaints within a reasonable timeframe. If the complaint is deemed valid, Sunathlete will ensure free repair, replacement, or refund, depending on the nature of the complaint.
7.6 Proof of warranty: This warranty is only valid upon presentation of a valid proof of purchase.

Article 8: Educational Services and Advice
8.1 The information and education provided by Sunathlete are carefully compiled and intended to support the use of the products.
8.2 Sunathlete is not liable for any damage resulting from incorrect use of the provided information or products. Customers are advised to seek professional medical advice when necessary.

Article 9: Liability
9.1 Sunathlete is only liable for direct damage resulting from intent or gross negligence.
9.2 Sunathlete is not liable for indirect damage, such as consequential damage, lost profits, or lost data.

Article 10: Privacy
10.1 Sunathlete processes personal data in accordance with applicable laws and regulations, as outlined in the privacy statement.

Article 11: Governing Law and Disputes
11.1 All agreements between Sunathlete and the customer are governed by Dutch law.
11.2 Disputes are preferably resolved through mutual consultation. If this is not possible, disputes will be submitted to the competent court in The Netherlands.
